RIVER RUNNERS’ TRANSPORT
HIRING AGREEMENT AND ACKNOWLEDGMENT OF RISK

_________________________("Employer") hereby agrees to pay River Runners’ Transport ("Contractor") $_____________ to shuttle vehicle(s) from __________________to _________________ by ______________(date/time) and to perform other work as described below under "Job Instructions." Such payment shall be made at the time the vehicle(s) is/are picked up, unless other an arrangements are made in advance. Employer grants Contractor permission to drive or otherwise transport the described vehicle(s).

EMPLOYER’S ASSUMPTION OF RISK

Knowing that the vehicle(s) may be unattended before pickup or after delivery by Contractor, and knowing that there are risks involved in completing the job as instructed, which risks include but are not limited to theft, vandalism, damage from fire or elements, and the possibility of hitting animals on roads, EMPLOYER HEREBY ASSUMES ALL RISKS of damage, loss or injury to any and all persons or property, including but not limited to the vehicle(s) and their contents resulting from Contractor’s performance under this agreement which are caused by Employer’s negligence or inherent risks with this type of activity.

EMPLOYER’S COVENANTS AND RESPONSIBILITIES

Employer covenants that the vehicle(s) will be in safe driving condition at the time of pickup, and agrees to be responsible for all damages, loss, injury, and liability resulting from a breach of this covenant. EMPLOYER ALSO COVENANTS THAT THE VEHICLE(S) WILL HAVE SUFFICIENT FUEL TO REACH THE DESTINATION, or else to make arrangements for fueling the vehicle(s) before it/they are picked up. If, upon arrival for pickup, the Contractor determines, as it may in its sole and absolute discretion, that the vehicle(s) is/are not in safe driving condition, the Contractor may elect not to transport the unsafe vehicle(s) and will reimburse the Employer for one-half of the previously paid shuttle fee, and be free of all further liability, duty or obligation.

The Employer agrees to be fully responsible for all costs and expenses which contractor necessarily incurs to repair mechanical problems or any towing expenses of the vehicle(s) or otherwise to fulfill the job instructions and to promptly reimburse Contractor for such upon the presentation of receipts thereof.

INSURANCE AND INDEMNIFICATION

Recognizing there is an element of risk involved in completing work under "Job Instructions," Employer agrees to hold harmless Contractor, its employees and/or agents and all persons or entities referring Contractor, including, but not limited to the Dinosaur National Monument, for loss, damage, injury or liability which may result in Contractor’s performance under this agreement in good faith.

Employer is solely responsible for insurance on the described vehicle(s), and warrants that insurance will be in force at all times  relevant to this agreement. Employer warrants the legality of all tasks which the Contractor is to perform under this agreement.
